What an outrage! You should send this photo to NS and the Shepherdsrtown police department, maybe even the State Department and Homeland Security (notice how easily he was able to influtrate the national rail system?). This kid needs to learn his lesson. Seriously Trainmasterrob, how many times will it take before this kid learns? If you have time, I would go track him down yourself and give him a piece of your ear, then make sure to give him my number so I can make sure he understands what a complete outrage this is!

The local police do what they can to keep people off the tracks, but it is a liberal town and mommy and dad want their children to be happy and free to do what makes them happy. Living next to these tracks gave me a good insight on what happens here. Late at night is when some drunk college students like to walk the bridge. When capturing a night photo, 3 college students ran off when they notice me standing in the shadows while wait to accomplish this night photo, http://www.railpictures.net/viewphoto.php?id=161218&nseq=0

I used a 400mm lens and the train was traveling at speed which is 40 mph through Shepherdstown. The only time I would hear the engineer laying on the horn was when somebody is on the tracks. It was about 3-4 seconds till the train reached German Street from the moment of the image.

Looks close enough to me, distance and use of a telephoto lens are both irrelevant issues! The gates are down, in plain english that means stop! I know "if" is a mighty big word, but what "if" this kid was struck and killed? Mommy and Daddy would probably sue the railroad and there would be a public outcry for more grade crossing deterrents to be put in place. Not to mention the fact that the crew would have to live with killing a human being.

Well, you know, patience is a virtue, and most people are not too virtuous anymore. Besides, if you check the "Rules of the Road" in practically ANY state, you find that bike riders are subject to the same rules as motor vehicles. DEFINITELY a "Darwin Award" winner!

It's a shame stuff like this happens. If the kid gets hit and killed, well, I suppose it's his own fault. But, the crew has to live with the fact that they killed somebody, especially a kid, for the rest of your life. That's what people just don't seem to understand about these types of incidents..

As Mark said, the kid's parents probably would have layed blame on the railroad, which obviously isn't valid. A train aint' gonna' swerve to miss a kid on a bike!

The kid rode his bike home to change his shorts. The engineer will be re-living this photo in his mind all night while he tries to get some sleep.

Looks like you caught the poster child for unsafe acts (no helmet, riding around gates). If he keeps this up the next place hell find himself is the local morgue!
