It's the consensus of Yahoo Birds Pix that this is a juvenile Red Tailed Hawk.
But it is a good photo, nonetheless.

That is not a Falcon it is actually a Young Red Tailed Hawk. It Appears to have gotten a few new Red Tail Feathers, which tells me that he is about 2 years old. He'll soon will find a mate and stay with it for life.
