People just don't get it, although we don't know for sure, most likely a cell phone was in his hand with an incoming or outgoing text taking place, he's lucky for the outcome, he could have been killed had the train been running faster, or he

10 to 1 says this genius gave the excuse of "I didn't see it." I dealt with situations like this around 6 times when I worked on the Great Miami and that was what they said every single time.

We have a loophole in the law here in the U.K. Seemingly it is only an offence to make a phone call with a hand set whilst driving. Other uses are not an offence, hence the police have to prove you were actually on a phone call. They are looking at changing the law to "Even if you just have the phone in your hand" type thing would be an offence.
